Terms and Conditions

1. The service

Kamanjat is a software platform offering a subscription service (software as a service, SaaS) with digital tools to process, display and analyse market data, including charts, technical indicators, statistical models, forecasting algorithms, historical back-tests, search and screening tools and educational content.

2. Fully automated AI outputs

1. All tool outputs are generated fully automatically by artificial-intelligence, machine-learning and statistical models and modern time-series techniques, based on historical data and the formulas and settings of each tool, without any human intervention in producing, editing, selecting or directing the result for any security.
2. The human role is limited to designing and programming the systems, training and maintaining the models and monitoring their technical integrity. No member of our team reviews, approves or sends outputs to any particular user.
3. The same models are applied in the same way to all securities and all users, so the output is the same for everyone who requests the same tool with the same inputs; it is never a personal opinion addressed to you.
4. AI models are probabilistic by nature. They can be wrong, and can be affected by missing or delayed data or by exceptional events not reflected in historical data. Results may change with the data, period, model or settings.

4. Eligibility and accounts

1. You must be at least 18 years old with full legal capacity.
2. You must provide accurate, complete and current information; we may suspend accounts with false information.
3. Accounts are personal and non-transferable. Sharing login credentials or using one account by more than one person is prohibited. We use technical means to detect such use and may suspend the account when it is established, subject to your right to object under clause 12.
4. You are responsible for keeping your password confidential and for all activity under your account, and must notify us immediately of any unauthorised use.
5. You are responsible for making sure your use of the service is permitted by the laws of your country of residence.

5. Plans, prices and payment

1. Plans, features and prices are shown on the subscription page in Saudi riyals; payment may be processed in another currency, such as US dollars, at the equivalent amount.
2. The final price, currency and any applicable taxes and fees are shown before you complete the purchase, and the amount shown on the payment confirmation page is the amount payable for the transaction.
3. Payments are processed by an independent payment service provider or by a merchant of record, depending on the payment method and country, whose name may appear on your statement. Completion of the payment may be subject to that party's terms, policies, verification and fraud-prevention requirements.
4. The site does not store full card numbers or card security codes; they are entered on payment pages hosted by the payment provider. Additional authentication may apply where required by the payment provider or the issuer of your payment method.
5. The issuer of your payment method may charge currency-conversion or international fees outside our control.
6. We may change prices and plans for the future; changes do not affect periods already paid.
7. Promotional prices and free bonus days are temporary benefits subject to the published offer terms and have no cash value.

6. Subscription term and activation

1. Subscriptions are prepaid for a fixed period (1, 3, 6 or 12 months) and do not renew automatically; no further amounts are charged without your explicit action.
2. The period starts on activation, which is automatic once the payment party confirms the payment; an electronic receipt is issued for every transaction.
3. When upgrading, the value of the remaining days of your current plan is credited against the upgrade price as shown on the upgrade page before payment.
4. Refunds and cancellations are governed by the Refund Policy, which forms part of these Terms.

7. Acceptable use

You must not: copy, resell, publish, broadcast or share indicators, content or data, wholly or partly, with or without charge; use bots, scrapers or any automated means to access or extract data; attempt to hack, bypass security, reverse-engineer algorithms or disrupt the service; use the service for unlawful activity including fraud, money laundering, market manipulation or spreading rumours or misleading information; present the site's outputs to others as investment recommendations or advice, or use them to provide any service or activity that requires a licence without holding it; abuse staff or other users or impersonate anyone. Such conduct is a material breach allowing suspension of the account, without prejudice to claims for damages and legal action, including under the Anti-Cyber Crime Law.

8. Intellectual property

All indicators, algorithms, formulas, software, designs, marks, names, logos, texts and graphics of the site are owned by or licensed to the Provider and are protected by copyright, trademark and related laws and treaties. No part may be copied, imitated or used commercially without prior written consent. Names and marks of models, technologies and platforms owned by third parties remain the property of their owners and are mentioned only to identify the technology used, without implying any partnership, sponsorship or endorsement. Your subscription grants a personal, limited, non-exclusive, non-transferable licence for the subscription period only.

9. Data sources and availability

• Tools may rely on third-party price data whose accuracy, completeness or timeliness we do not guarantee and which may be delayed.
• Accuracy figures and back-test results describe a model's performance on past data using the stated methodology and are not a guarantee of future accuracy.
• We use reasonable care to keep the service available. It is provided "as is" and "as available" and may be interrupted for maintenance, updates or reasons beyond our control, subject to the Refund Policy for material outages.
• We may develop, change, replace or discontinue tools without materially reducing the features of a paid plan during its paid period.

10. Limitation of liability

To the extent permitted by applicable law, the Provider is not liable for investment or trading losses arising from an independent decision you make based on your interpretation of the tools' outputs, nor for loss of profits or indirect or consequential damages. Otherwise, our total liability to you shall not exceed the amount you actually paid us in the twelve months preceding the claim. Nothing in this agreement excludes or limits any liability or right that the law does not allow to be excluded or limited, including liability for fraud or gross negligence and mandatory consumer rights.

11. Indemnity

To the extent permitted by law, you will compensate the Provider for damages and reasonable costs arising directly from your breach of these Terms or the law, or your misuse of the service.

12. Suspension, termination and objections

You may stop using the service at any time. We may suspend or terminate an account for breach of these Terms, reasonable suspicion of fraud or unlawful use, or at the request of a competent authority. You may object to any suspension by e-mail within 14 days, and we will reply with reasons within 5 business days. Provisions on intellectual property, liability and disputes survive termination.

13. Payment issues and chargebacks

Please contact us first about any payment issue; we will handle it fairly and promptly, usually within one business day. This clause does not limit your right to dispute a transaction with the issuer of your payment method under its rules; we may temporarily suspend the account while the dispute is decided and provide evidence of the transaction and of the use of the service.

14. Force majeure

We are not liable for delays or failures caused by events beyond our reasonable control, such as disasters, epidemics, network, data-provider or hosting outages, cyber attacks or government actions.

15. Notices

You agree to receive service notices electronically by e-mail or on the site; notices sent to your registered e-mail are effective. Notices to us: admin@kamanjat.com.

16. Governing law and disputes

These Terms are governed by and construed in accordance with the laws of the Kingdom of Saudi Arabia. The parties will try to settle any dispute amicably within thirty days of written notice; failing that, the competent judicial authorities in the Kingdom of Saudi Arabia have jurisdiction. This does not affect a consumer's right to complain to the competent consumer-protection authorities or any mandatory rights in the consumer's country of residence.

17. General

• If any provision is held invalid or unenforceable, the rest remains in force.
• Failure to exercise a right is not a waiver.
• The Provider may transfer its rights and obligations to a legal successor bound by these Terms; you may not assign your account or rights.
• The Arabic text prevails over any translation.
• We may amend these Terms and will announce material changes a reasonable time before they take effect. Changes will not reduce your rights for a period already paid, and continued use after they take effect means acceptance.
